TERMS OF SERVICE

Please read these Terms of Service ("Terms") carefully before using the Settlewood application ("App") operated by Cedar & Fog Labs, LLC ("we", "us", or "our").

By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. DESCRIPTION OF SERVICE

Settlewood is a photo-based home organization tool. You upload photos of rooms or storage areas, and the App uses artificial intelligence to analyze clutter and provide keep/trash/relocate recommendations.

2. ELIGIBILITY

You must be at least 13 years old to use this App. By using the App, you represent that you are at least 13 years of age.

3. USER ACCOUNTS

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. CONTENT LICENSE

You retain full ownership of all photos you upload. By using the App, you grant us a limited, non-exclusive license to process your photos solely for the purpose of providing the analysis service. We do not use your photos for model training, advertising, or resale.

5. AI-POWERED ANALYSIS DISCLAIMER

The App uses Anthropic's Claude AI to analyze your photos and provide organizational recommendations. These recommendations are informational only and do not constitute professional organizing, appraisal, or advisory services.

AI analysis may contain errors, inaccuracies, or inappropriate suggestions. You are solely responsible for any decisions you make based on the analysis results, including decisions to keep, discard, or relocate items. We strongly recommend exercising independent judgment before acting on any AI recommendation, especially for items of sentimental, monetary, or legal value.

WE ARE NOT RESPONSIBLE FOR ANY LOSS, DAMAGE, OR HARM RESULTING FROM ACTIONS TAKEN BASED ON AI RECOMMENDATIONS.

6. ACCEPTABLE USE

You agree not to: - Upload photos of spaces you do not own or have permission to photograph - Upload illegal content, CSAM, or intimate images of others without consent - Use the App for any unlawful purpose - Attempt to reverse-engineer, hack, or disrupt the App or its infrastructure - Upload photos primarily containing people (the App is designed for rooms and spaces)

7. THIRD-PARTY SERVICES

The App uses the following third-party services to provide its functionality: - Anthropic (Claude AI) — for photo analysis. Your photos are sent to Anthropic's API for processing. Anthropic's API data retention policy applies. - Amazon Web Services (AWS) — for photo storage (S3), user authentication (Cognito), and compute (Lambda). Data is encrypted at rest and in transit.

8. LIMITATION OF LIABILITY

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

9. ARBITRATION AND DISPUTE RESOLUTION

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration administered under applicable rules, rather than in court. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION.

10. ACCOUNT TERMINATION

We reserve the right to suspend or terminate your account at any time for violations of these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Cedar & Fog Labs, LLC and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the App, your violation of these Terms, or your violation of any rights of another party.

12. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to conflict of law principles. Any legal action arising from these Terms shall be brought in the state or federal courts located in the State of Washington.

13. MODIFICATIONS

We may update these Terms from time to time. We will provide at least 30 days' notice of material changes. Continued use of the App after changes take effect constitutes acceptance.

14. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

15. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cedar & Fog Labs, LLC regarding your use of the App and supersede any prior agreements.
